The Children’s Ombudsman reported that 2,178 children and adolescents (CALs) suffered violations of their human rights in the social epidemic that began on October 18, 2019.

The organization published the figure on the third anniversary of the mobilizations that paralyzed the country, specifying that thanks to the latest update, registered violations against minors during this period increased by 864.

“These violations of the human rights of children and adolescents during the social epidemic were serious and systematic,” warned the organization led by Patricia Muñoz.

The ombudsman also charged that only 1.2% of these types of cases resulted in formal charges against a government agent, describing the figure as “alarming”.

Although the institution had already disclosed several documents and background information on this matter, highlighting the chapter contained in its 2020 annual report and the Truth, Justice and Reparation report published in October 2021, this new publication provides news on the characteristics of the victims of institutional violence that correspond to the group of children and adolescents and the procedural status of the cases.

In the context of the consideration of the State of Chile before the Committee on the Rights of the Child in May this year, This was announced by the public ministry the consolidated national number of cases of victims under the age of 18 of violations of their human rights in the context of social unrest is 2 thousand 178, which is a significantly higher number than was handed to the Children’s Ombudsman in 2020, which reached 1,314 cases. These previous cases were later confirmed by the Ministry of Public Law, confirming more than two thousand cases of institutional violence, which mostly correspond to the commission of the crime of illegal coercion (74%).

In relation to the procedural status of the cases and as already warned by a technical note from the Children’s Rights Ombudsman Observatory (April 2021), there is very little progress in obtaining justice: only 1% have completed with a court decision, with only two cases having a final verdict. Of the total number of cases, 76% (1,461) were concluded, most of which were concluded by non-judicial proceedings and more specifically by “file”, reaching 56% of the total number of cases.

“Given the seriousness of the crimes represented by the violence committed by public officials, these figures are very disturbing, especially the 56% of cases closed due to the prosecutor’s application of the power of temporary filing.
